Manitow Inc. ("ManiTow", "Company", "we", or "us") gathers information from customers ("customers" or "you") using its www.manitow.ca  website and the Manitow mobile software application and platform (collectively referred to as the "ManiTow Service"). This Privacy Policy explains how we collect and use your information.

ManiTow offers an online platform where customers can connect with vendors providing roadside assistance and tow services (hereafter, "Providers"). This Privacy Policy covers all aspects of the Manitow Service, whether "online" (e.g., the Manitow.ca website and Manitow mobile application, accessed and used via personal computers, mobile devices, or otherwise) or "offline" (e.g., data collection through mailings, telephone, or in-person interactions) activities owned, operated, provided, or made available by Manitow. This Privacy Policy also applies to your use of interactive features or downloads that: (i) we own or control; (ii) are available through the Manitow Service; or (iii) interact with the Manitow Service and post or incorporate this Privacy Policy.

By accessing https://www.manitow.ca/ or the Manitow application and using the services offered, the user acknowledges having read and understood this policy of use and protection of personal data, as well as the practices of obtaining consent and the collection and processing of information described on this page. These privacy policies are based on and follow the current Canadian legal framework, in which case, the Privacy Act and PIPEDA Act are the main references.

In this sense, in accordance with the Privacy Act and PIPED Act, Manitow Techologies Inc. through its website www.ManiTow.ca and its Manitow mobile application, is committed to comply with and contribute to the implementation of the 10 fair information principles, following the recommendations described in the document. Privacy Guide for Businesses: What Canadian Businesses Need to Know to Comply With Federal Privacy Law (Office of the Privacy Commissioner of Canada).

PROTECTION OF DATA SECURITY

We employ standard, industry-wide, commercially reasonable security measures such as encryption, firewalls, and SSL (Secure Socket Layers) to safeguard your information – including portions of your credit card number that we retain (we do not retain your entire credit card information ourselves) and geo-location data. Please be aware that data transmitted over an open network, like the Internet or email, may be accessible to anyone. We cannot guarantee the confidentiality of any communication or material sent via such open networks. When sharing information through an open network, you should be mindful of the fact that it may be accessed by others and thus can be collected and used by others without your permission. Specifically, while individual data packets are often encrypted, the names of the sender and recipient are not. A third party may, therefore, be able to trace an existing bank account or relationship or one that is subsequently created. Even if both the sender and recipient are in the same country, data may be transmitted via such networks to other countries regularly and without controls, including countries that do not provide the same level of data protection as your country of residence. Password-protected areas of the Manitow Service can only be accessed with a valid username and password. Each password owner is responsible for keeping the password confidential and secure, as Manitow has no control or responsibility for this type of customer information. If the password might have been stolen or could be misused, it is the password owner's responsibility to notify Manitow immediately for further action. Your data may be lost during transmission or accessed by unauthorized parties. We do not accept liability for direct or indirect losses concerning the security of your information or data during its transfer via the Internet. Please use alternative means of communication if you consider it necessary or prudent for security reasons.

2. Identifying

2.1 Identify and document your purposes for collecting personal information.

A. DEFINITION OF PERSONAL – PRIVATE INFORMATION

Our company understands (but is not limited to) "Personal Information" as: any information necessary for the proper and efficient use of our services, which is sensitive, private and requires specific treatments. This information includes: Full Name, ID, E-mail, User Password, precise details of the vehicle (license plate, model, color, among others), banking information (Credit Card Number, expiration date & security code and or information regarding your PayPal, Google Wallet or other digital payment accounts).

In addition to Personal Information, we may collect other non-personally identifiable information related to your use of the Manitow Service, as discussed below. Some features and aspects of the Manitow Service may require different types and forms of Personal Information. You can opt out of providing Personal Information by not entering it or not using the Manitow Service, although not providing certain requested Personal Information may hinder your ability to use the Manitow Service or its features or aspects.

B. PURPOSES FOR COLLECTING PERSONAL INFORMATION

Our primary objective in gathering your Personal Information or Usage Information is to offer you the Manitow Service.

We may send you emails to deliver the Manitow Service, such as verifying your username and password, addressing your inquiries, providing requested services, and managing your account. Communication will be done via email, phone, or SMS based on your preferences.

We use information collected from our Mobile Application for troubleshooting and, in some cases, marketing purposes. Your Internet Protocol (IP) address helps us diagnose issues with our computer server and administer our website(s). Although your IP address helps identify you, it doesn't contain personal information.

By registering for the Manitow Service, you consent to receiving announcements about Manitow and its services: (1) providing requested information, services, or transactions, including electronic newsletters, special offers, or promotional materials on our or third parties' behalf; (2) processing your registration with Manitow Services, including verifying your information is active and valid; (3) improving the Services, customizing your experience, or providing content relevant to you; (4) enabling participation in online or mobile sweepstakes, contests, or other promotions; (5) contacting you regarding your use of Manitow Services and, at our discretion, changes to the services and/or policies; (6) for internal business purposes; (7) for data analytics; (8) addressing maintenance or other issues with Manitow Service; and (9) for purposes disclosed when you provide your information or as outlined in this Privacy Policy. If you don't wish to receive these, you can deactivate your Manitow account.

Please note that information submitted through a "contact us" or similar function may not receive a response.

C. PURPOSES FOR COLLECTION & USE OF NON-PERSONAL INFORMATION  

In addition to Personal Information, we and our third-party service providers may utilize a variety of technologies that automatically (or passively) collect specific information whenever you visit or engage with the Manitow Service ("Usage Information"). This Usage Information may comprise the browser you are using, the URL that directed you to the Manitow Service, all areas within the Manitow Service that you visit, the time of day, and other information. We may use Usage Information for multiple reasons, including enhancing or improving the Manitow Services. Furthermore, we collect your IP address or another unique identifier ("Device Identifier") for your computer, mobile, or other devices used to access the Services (collectively, a "Device"). A Device Identifier is a number automatically assigned to your Device used to access the Manitow Service, and our computers recognize your Device by its Device Identifier. Usage Information may be non-identifying or connected to you. When we associate Usage Information or a Device Identifier with your Personal Information, we will treat it as Personal Information.

Additionally, tracking information is gathered as you navigate our Services, including but not limited to geographic areas. If you access the Manitow Service while traveling in a vehicle, your mobile phone will transmit your GPS coordinates to our servers. Most GPS-enabled mobile devices can pinpoint one's location within 50 feet. We collect this information for various purposes, including determining the charge for the transportation you requested via our Manitow Services, providing you with customer support, sending you promotions and offers, enhancing Manitow Service, and for our internal business purposes. We may also have features that let you share this information with others (such as your family, friends, or colleagues) if you choose.

Several methods may be used to collect Usage Information, including but not limited to the following (and subsequent technology and methods developed in the future):

Cookies. A cookie is a data file placed on a Device when it is used to access the Manitow Service. A Flash cookie is a data file placed on a Device through the Adobe Flash plug-in that may be built-in or downloaded by you to your Device. Cookies and Flash Cookies can be used for numerous purposes, including remembering you and your preferences and tracking your visits to our web pages. Cookies function by assigning a number to the user that has no meaning outside the assigning website.

If you prefer not to have information collected through cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled or managed by setting a preference within your web browser or on your Device. If you decide to disable cookies or Flash cookies on your Device, some features of the Services may not operate correctly or may not customize the delivery of information to you.

Please note that the Company cannot control the use of cookies (or the resulting information) by third parties, and the use of third-party cookies is not covered by our Privacy Policy.

Web Beacons. Small graphic images or other web programming code called web beacons (also known as "1x1 GIFs" or "clear GIFs") may be included in our web and mobile pages and messages. Web beacons are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web users. In contrast to cookies, which are stored on a user's computer hard drive, web beacons are embedded invisibly on web pages and are roughly the size of the period at the end of this sentence. Web beacons or similar technologies help us better manage content on the Manitow Service by informing us what content is effective, count users of the Manitow Service, monitor how users navigate the Manitow Service, count how many emails that we send were actually opened, or count how many specific articles or links were viewed. We do not link the information gathered by web beacons to the customers personal information.

Embedded Scripts. An embedded script is programming code created to gather information about your interactions with the Manitow Service, including the links you click on. The code is temporarily downloaded onto your Device from our web server or a third-party service provider, it remains active only while you are connected to the Manitow Service, and it is deactivated or deleted afterward.

D. PURPOSES FOR USER INFORMATION FROM THIRD PARTIES

We use third-party companies and individuals to facilitate Manitow Service, provide or perform aspects of the service on our behalf, such as hosting, designing, and/or operating features, tracking analytics, processing payments, anti-fraud and security measures, customer support, providing geo-location information to our drivers, sending special offers, hosting job application forms, performing technical services (e.g., maintenance, database management, web analytics, and improving features), or other administrative services. We provide vendors with access to user information, including Personal Information, limited to the information needed to perform their services for you or us. Vendors are obligated not to disclose or use Personal Information for other purposes. This exception doesn't include third-party analytics service providers that evaluate and provide us with information about Manitow Service usage and content viewing. Such providers may set and access their cookies, web beacons, and embedded scripts on your device and collect or have access to non-personally identifiable information.

We use a third party hosting provider who hosts our support section of our website. Information collected within this section of our website is governed by our Privacy Policy.

Occasionally, we may supplement the information we gather about you via the Manitow Service with external records from third parties to improve our ability to serve you, customize our content for you, and present you with opportunities to buy products or services we think may interest you. We may merge the information we obtain from these sources with the information we collect through the Manitow Service. In such instances, we will apply this Privacy Policy to any Personal Information acquired, unless we have stated otherwise.

E. INFORMATION SUBMITTED BY THIRD PARTY RELATED TO MANITOW

If you decide to utilize our referral service to inform a friend about Manitow Service or other Manitow-related activities (e.g., job opportunities), we will request your friend's name and email address. We will automatically send your friend a one-time email inviting them to explore the Manitow Service. This information is stored solely for the purpose of sending this single email and monitoring the effectiveness of our referral program, and we do not use this information for any other marketing purposes unless we receive permission from that individual or explicitly state otherwise. Please note that when using any referral feature provided through the Manitow Service, your email address may be included in the message sent to your friend. If you or your friend would like us to remove this information from our database, please contact us via email at info@manitow.ca

F. THIRD-PARTY CONTENT & LINKS

Manitow Service may include content provided by a third party, and those third parties may gather website usage information and your Device Identifier when web pages from any online or mobile service connect to your browser. Additionally, while using the Manitow Service, you may be directed to other sites or applications operated and controlled by third parties that are beyond our control. We are not accountable for the privacy practices employed by any of these third parties. For instance, if you click on a banner advertisement, the click may take you away from one of our websites onto a different website. These other websites may send their own cookies to you, independently collect data or request Personal Information, and may or may not have their own published privacy policies. We encourage you to be aware of when you leave the Manitow Service and to read the privacy statements of all third-party websites or applications before submitting any Personal Information to third parties.

G. PURPOSES FOR INFORMATION COLLECTED BY THE MANITOW MOBILE APPLICATION

The Manitow Service is primarily accessible through the application on your mobile, tablet computer, or similar device (the "Mobile Application"). You agree that we may gather and use technical data and related information, including but not limited to, technical details about your device, system and application software, and peripherals, which is collected periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to such Mobile Applications.

When utilizing any of our Mobile Applications, the Mobile Application may automatically gather and store some or all of the following information from your mobile device ("Mobile Device Information"), including without limitation:

  • Your preferred language and country site (if applicable)
  • Your phone number or other unique device identifier assigned to your mobile device – such as the International Mobile Equipment Identity or the Mobile Equipment ID number
  • The IP address of your mobile device
  • The manufacturer and model of your mobile device
  • Your mobile operating system
  • The type of mobile Internet browsers you are using
  • Your geolocation

Information about your interactions with the Mobile Application and any other aspects of the Manitow Service to which the Mobile Application connects, such as the frequency of using a specific part of the mobile application over a given time period, the duration of Mobile Application usage, usage patterns, actions taken within the Mobile Application, and engagement with the Mobile Application.

Information that allows us to personalize the services and content available through the Mobile Application. We may use information automatically collected by the Mobile Application (including the Mobile Device Information) in the following ways:

  • To operate and enhance our Mobile Applications, other Services, our company's services, and tools;
  • To create aggregated and anonymized information to determine the most popular and useful Mobile Application features for users, and for other statistical analyses;
  • To prevent, detect, and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the Mobile Application, and to investigate fraud, chargebacks, or other matters;
  • To customize the content or services on the Mobile Application for you, or the communications sent to you through the Mobile Application.

Regarding the geo-location data we track through your Mobile Device, we use that information for various purposes – including allowing you to view nearby drivers in your area, setting your vehicle location for drivers to find the location where you require services, sending promotions and offers, and enabling you (if you choose through any features we may provide) to share this information with others. Except as otherwise permitted in this Privacy Policy, we will not share this information with third parties for any purpose and will only use this information for the sole purpose of providing you with the ability to request services via Manitow's Mobile Application. You may, at any time, disable our Mobile Application's access to your location by turning off this feature at the Mobile Device level.

We also provide some of your Personal Information (such as your first name and your photo, if you have chosen to upload your photo to your profile) to the driver/partner who accepts your request for roadside service, so they can contact and locate you. The companies that drivers work for (providing the roadside service) can also access your Personal Information, including your geo-location data.

We may associate your unique mobile Device Identifier or Mobile Application usage information with any Personal Information you provide, but we will treat the combined information as Personal Information.

Personal Information may also be collected and shared with third parties if you specifically and knowingly upload, share, or transmit content from the Mobile Application to an email recipient, online community, website, or the public, such as uploaded photos, posted reviews or comments, or information about you or your services that you choose to share with others through features that may be provided on our Services. This uploaded, shared, or transmitted content will also be subject to the privacy policy of the email, online community website, social media, or other platform to which you upload, share, or transmit the content.

H. PURPOSES FOR INFORMATION COLLECTED FROM JOB APPLICANTS.

If you want to apply for a job with Manitow, we will gather Personal Information like your name, email address, phone number, and may also collect additional details like your resume. We use the information gathered in this section of the website(s) to assess your qualifications for the position you have applied for and to get in touch with you to arrange an interview.

2.2 Tell ours customers why our company needs their personal information before or at the time of collection. Depending on how the information is collected, this can be done orally or in writing.

A. PERSONAL INFORMATION

Manitow Inc. through www.ManiTow.ca website and the Manitow mobile software application and platform collects personal data and information because it is necessary for the provision of a complete and efficient service by our company and suppliers (third parties involved in the service).

Accordingly we understand that personal information collected during any time of use or service provided by the Company through www.ManiTow.ca website and the Manitow Mobile Software Application and platform, is defined (but not limited) as follows:

  • Name
  • E-mail address
  • Mobile phone number,
  • Billing address,
  • Personal vehicle information
  • Credit card account information ("Personal Information").

Credit Card Number, expiration date & security code and or information regarding your PayPal, Google Wallet or other digital payment accounts. You also have the option to upload a photo when registering for the Manitow Service. You may remove or update the photo at any time by logging into your account. All of the foregoing (including your photo) shall be referred to as "Personal Information" hereafter. The Personal Information you share with us (including your photo, if submitted) will be viewable by and shared with Providers in connection with requests you submit for roadside assistance services to verify your identity and bill your credit card account for services you order. This information is important because the payment for the services purchased will be made electronically through the digital payment platforms described above.

  • We also may collect this information through various forms and places within the Manitow Service, including account registration forms, contact forms, or when you interact with us. For example, when you sign up for the Services, you create a user profile.

In addition to Personal Information, we may collect other non-personally identifiable information related to your use of the Manitow Service, as discussed below. We may share non-personally identifiable information, like aggregated user statistics and log data, with third parties for industry analysis, demographic profiling, targeted advertising, or other business purposes. We don't sell, share, rent, or trade collected information, including Personal Information, except as disclosed in this Privacy Policy or when you provide the information. We don't share your Personal Information with third parties for their direct marketing purposes unless you consent at the time you provide your Personal Information. We may share user information of all types (including Personal Information) under the following circumstances:

(a) You Request Information From Third Parties.

You can choose to have your Personal Information shared to receive information and/or marketing offers directly from third parties. If you agree, your Personal Information will be disclosed to such parties, subject to their privacy policies and practices. We're not responsible for third parties' privacy policies and practices, so review them before agreeing to receive information. If you later decide to stop receiving communication from a third party, you must contact them directly.

(b) Third-Party Service Providers

If you decide to participate in a sweepstakes, contests, and other promotions (collectively referred to as a "Promotion") through the Manitow Service, you are agreeing to the official rules that govern that Promotion, which may include specific requirements for you, such as allowing the sponsor of the Promotion to use your name, voice, and/or likeness in advertising or marketing related to the Promotion. If you choose to enter a Promotion, Personal Information may be disclosed to third parties or the public in connection with the administration of the Promotion, including, in relation to winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.

(d) Legal Protection and Compliance

We collaborate with government and law enforcement officials and private parties to enforce and comply with the law. As a result, we may access, use, preserve, transfer, and disclose your information (including Personal Information), including disclosure to third parties such as government or law enforcement officials or private parties, as we reasonably determine is necessary and appropriate: (i) to comply with any applicable law, regulation, subpoenas, governmental requests, or legal process; (ii) to protect and/or defend the Terms and Conditions for the Manitow Service, including investigating potential violations thereof; (iii) to safeguard the safety, rights, property, or security of the Company, the Manitow Service, or any third party; (iv) to ensure public safety for any reason; (v) to detect, prevent, or address fraud, security, or technical issues; and/or (vi) to prevent or halt activity we may consider being, or posing a risk of being, illegal, unethical, or legally actionable activity. Furthermore, we may use IP addresses or other Device Identifiers to identify users and may do so in cooperation with third parties such as copyright owners, internet service providers, wireless service providers, and/or law enforcement agencies, including disclosing such information to third parties, all at our discretion. Such disclosures may be carried out without notice to you, subject to applicable law.

(e) Business Transfer.

We may share your information, including your Personal Information and Usage Information, with our parent company, subsidiaries, and affiliates for internal purposes. We also maintain the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner, or operator of the Manitow Service or relevant database; or (ii) in relation to a corporate merger, consolidation, bankruptcy, restructuring, the sale of significantly all of our equity interests and/or assets, or other corporate transformation, including during any due diligence process. To the greatest extent permitted by law, the Privacy Policy will apply to the user information transferred to the succeeding entity. However, user information submitted following a transfer to a successor entity may be subject to a new privacy policy adopted by that succeeding entity.

Manitow Inc. using its www.ManiTow.ca website and the Manitow mobile software application and platform, is committed to update or include, whenever necessary, new purposes for the collection, processing and use of Personal and Non-Personal Data. Likewise, whenever changes or updates to the privacy policy are generated, customers (users and suppliers) will be informed by email that is registered from the time of opening the profile or use of any services offered by our company.

3. Consent (Obteain Valid, Informed Consent)

Our company is committed to request full and free informed consent in each of the steps where it is necessary to collect any type of personal or non-personal information. In this way, Manitow Inc. gathers information from customers ("users" or "providers"), using its www.ManiTow.ca website and the Manitow mobile software application and platform, will generate the mechanisms in each of the forms and services offered by our company so that the privacy policy and the use of data is sufficiently clear and relevant, achieving in this way that each of the customers (users or providers) have availability and access to all the corresponding information.

This information will be available through the different documents that will be stored virtually and to which all users and visitors of the website www.ManiTow.ca and the Manitow phone application will have free access. Such documents include (but are not limited to) the following:

It is valid to clarify that once all documentation is made available to users, and at the time of registering and making use of the services offered by the Company, it will be frequent that the platforms (web and app) will constantly ask about the understanding and informed consent of the different policies governing our services.

After some time, your data may be anonymized and aggregated, and we may hold it as long as necessary for us to provide the Manitow Service effectively, but our use of the anonymized data will be solely for analytical purposes.

Manitow's Right to Amend this Privacy Policy. Occasionally, we may update this Privacy Policy to reflect changes in our information practices. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or by means of a notice on the Services before the change becomes effective. La Compañía se compromete a recolectar y salvaguardar la información personal y no personal recolectada por cualquier medio el tiempo que sea necesario en tanto el cliente (usuarios y/o proveedores) tenga activo el perfil de usuarios. En ese caso Manitow conservara la información personal y no personal bajo los protocolos explicados ampliamente dentro de este documento.

En caso de que el usuario no haga uso de los servicios ni este activo dentro del perfil, se tomará un tiempo prudente de 1 (un) año para hacer el cierre de la cuenta y destrucción de los datos personales y no personales recolectados por la compañía y sus proveedores. Se aclara que antes del cierre de la cuenta por parte de la compañía se dará previo aviso vía correo electrónico registrado dentro del perfil de usuario.

Se deja claro que los usuarios (clientes y proveedores) tienen total acceso a su información personal y no personal. En caso de querer generar algún cambio y/o actualización de la información personal será posible en cualquier momento por medio de correo electrónico support@manitow.ca,  o a través de nuestra página web www.ManiTow.ca o la aplicación móvil ManiTow.

6. Accuracy

The collection and use of private and non-private information will always be directed and supervised by the Information and Data Security Officer designated by the Company. On the other hand, the Company is committed to prepare both our employees and providers regarding the company's privacy policies. Such training will be done according to the demand and development of the company.

7.1 DATA SECURITY

The Company employ standard, industry-wide, commercially reasonable security measures such as encryption, firewalls, and SSL (Secure Socket Layers) to safeguard your information – including portions of your credit card number that we retain (we do not retain your entire credit card information ourselves) and geo-location data. Please be aware that data transmitted over an open network, like the Internet or email, may be accessible to anyone. We cannot guarantee the confidentiality of any communication or material sent via such open networks. When sharing information through an open network, you should be mindful of the fact that it may be accessed by others and thus can be collected and used by others without your permission. We do not accept liability for direct or indirect losses concerning the security of your information or data during its transfer via the Internet. Please use alternative means of communication if you consider it necessary or prudent for security reasons.

Se resalta que para el registro y uso de nuestros servicios es necesario suministrar toda la información solicitada además de que se preguntara sobre el consentimiento informado dentro de cada uno de los pasos de registro. Nuestras políticas de privacidad estarán disponibles y de fácil acceso en nuestra página web o por medio de la aplicación móvil ManiTow.

Por otro lado, la Compañía se compromete a preparar a los empleados y proveedores respecto a las políticas de privacidad de la información por medio de talleres introductorios que serán realizados de forma virtual y bajo la supervisión del encargado de Seguridad y Privacidad de Datos.

8.2 MAKE THESE POLICIES AND PRACTICES EASILY UNDERSTANDABLE AND EASILY AVAILABLE

La Compañía se compromete a poner a disposición de los clientes (usuarios y proveedores) en todo momento de registro y uso de nuestros servicios, toda la documentación necesaria para el buen y fácil entendimiento de nuestras políticas de privacidad y de seguridad de datos e información. En todo caso, durante el registro y apertura del perfil de usuario sera necesario aceptar las diferentes políticas de privacidad haciendo entender a la Compañía la previa lectura de los documentos y dando el consentimiento informado necesario para el uso de la información personal y no personal.

Se pondrá a disposición de nuestros clientes (usuarios y proveedores) un documento corto a modo de resumen que explique los 10 principios establecidos por la PIPEDA Act, y a los cuales se compromete la Compañía.

Cualquier duda, comentario o sugerencia respecto a la privacidad de datos e información, será recibida vía correo electrónico.

9. Individual Access

9.1 WHEN ASKED, ADVISE PEOPLE ABOUT THE PERSONAL INFORMATION ABOUT THEM YOUR ORGANIZATION HOLDS

La Compañía se compromete a dar respuesta a solicitudes enviadas vía correo electrónico en las cuales se exprese la intención de los clientes (usuarios y/o proveedores) de conocer o tener copia de la información personal y no personal recolectada por la compañía y usada por la misma y los proveedores, para la prestación de un buen servicio.

Será posible también acceder a la información registrada por medio del perfil de usuario creado para hacer uso de los servicios ofrecidos por Manitow Inc. using its www.ManiTow.ca website and the Manitow mobile software application and platform.

9.2 GIVE PEOPLE ACCESS TO THEIR INFORMATION AT MINIMAL OR NO COST, OR EXPLAIN YOUR REASONS FOR NO PROVIDING ACCESS.

Manitow Inc. using its www.ManiTow.ca website and the Manitow mobile software application and platform, pondrá a disposición de los clientes (usuarios y proveedores) mecanismos para solicitar la información personal y no personal suministrada en cualquier momento al momento de consulta y uso de nuestros servicios y/o marketing llevado a cabo por la Compañía. Dichos mecanismos se darán por medio de correo electrónico en cuyo caso el usuario, desde su cuenta, tendrá que escribir un mensaje al correo support@manitow.ca, dirigido al área encargada de Seguridad y Privacidad de Datos e Información solicitando la información personal y no personal que se necesite.

Por otro lado, por medio de la página web y de la aplicación movil, la Compañía pondra a disposición de los usuarios los recursos virtuales necesarios para solicitar la información personal y no personal guardada por nuestra compañía. En todo caso, se aclara que al momento de hacer cualquier solicitud se aplicaran protocolos de comprobación de identidad que serán desde preguntas personales hasta reconocimiento facial por medio fotográfico, todo lo cuál tendrá que ser corroborado por nuestra compañía para el cumplimiento de nuestra política de privacidad.  

9.3  HELP PEOPLE PREPARE THEIR REQUEST FOR ACCESS TO PERSONAL INFORMATION

La Compañía se compromete a desarrollar los mecanismos necesarios para que los clientes (usuarios y proveedores) tengan fácil acceso y posibilidad de hacer solicitudes para obtener copia y/o cambiar la información personal y no personal recolectada en cualquier momento de consulta y/o uso de los servicios prestados por la compañía y sus proveedores.

La Compañía pondrá al servicio, formularios que ayudaran a que los clientes (usuarios y proveedores) puedan hacer solicitudes de acceso a la información personal y no personal recolectada por la compañía durante la prestación de alguno de sus servicios por medio de la página web y/o aplicación móvil Manitow. Las solicitudes dirigidas al correo electrónico  support@manitow.ca, tendrán un plazo de respuesta de no máximo 30 días. En cuyo caso sea necesario más tiempo, la compañía se compromete a contactar al usuario (por medio electrónico o mensaje de texto) para hacerle saber la razón justificada por la demora en la respuesta.

9.4 NOTE ANY DISPUTES ON THE FILE AND ADVISE THIRD PARTIES

10. Challenging Compliance

10.1 AN INDIVIDUAL MUST BE ABLE TO CHALLENGE YOUR ORGANIZATION’S COMPLIANCE WITH THE FAIR INFORMATION PRINCIPLES.

La compañía se compromete a construir los canales necesarios para las Peticiones, Quejas y Reclamos que tengan los clientes (usuarios y proveedores) respecto a las políticas de privacidad y uso de la información personal y no personal. En ese caso, los usuarios se encuentran en todo derecho a reclamar el cumplimiento de los 10 principios establecidos por el Act. PIPEDA.

Dichas reclamaciones serán tratadas en el área de Seguridad y Privacidad de la Información según los protocolos establecidos haciendo la revisión exhaustiva para determinar, internamente, si hubo una falla o incumplimiento de alguno de los 10 principios establecidos por el Act. PIPEDA y que haya vulnerado alguno de los derechos de los usuarios respecto al manejo de la información personal y no personal de la que hace uso la compañía.

Se dará respuesta  oportuna a la reclamación en un plazo no máximo de 30 (treinta) días. en  caso de ser requerido más tiempo, la compañía se compromete a contactar con el usuario de forma electrónica y hacerle saber la razón de la demora.

La compañía se compromete a corregir cualquier mala practica e incumplimiento de los 10 principios establecidos por el Act. PIPEDA y que rigen a todo este texto.

11. OTROS

11.1 WHAT IS ONLINE BEHAVIORAL ADVERTISING AND HOW CAN I OPT-OUT?

Online Behavioral Advertising (also known as Targeted Advertising) involves gathering information on an individual's web or mobile browsing behavior, such as visited pages or searches made. This data is then used to determine which ads should be shown to a specific customer on websites other than our own. For instance, if you've demonstrated an interest in nursing on our site(s), you may be shown an ad for nursing-related programs when visiting a site other than ours. To opt out of targeted advertising from us when visiting our third-party advertising publishers, please email marketing@manitow.ca Note that this will opt you out of targeted ads from our Company and any other participating advertisers. If you opt out, you may still receive online advertising from us, but these ads may be less relevant to you.

For behavioral advertising opt-outs to work on your device, your browser must be set to accept cookies. If you delete cookies, purchase a new device, access our Services from another device, log in under a different screen name, or change web browsers, you will need to opt out again. If your browser has scripting disabled, you don't need to opt out, as online behavioral advertising technology doesn't function when scripting is disabled. Check your browser's security settings to verify whether scripting is active or disabled.

Many network advertising programs let you view and manage interest categories compiled from your online browsing activities. These interest categories help determine the types of targeted ads you may receive. The NAI Opt-Out Page offers a tool that identifies member companies with cookies on your browser and provides links to those companies.

11.2 SOCIAL MEDIA FUNCTIONS AND TOOLS

Manitow Service may incorporate social media functions, such as the Facebook Like button, and tools like a "Share This' ' button, or interactive mini-applications that operate on our online and mobile platforms. These functions may gather your IP address, the page you are viewing on our online or mobile platform, and may place a cookie to allow the function to work correctly. Social media functions and tools are either hosted by a third party or directly by Manitow. Your interactions with these functions and tools are regulated by the privacy policy of the company providing them.

11.3 MINORS FORBIDDEN FROM USING THE MANITOW SERVICE

Manitow is concerned about children's safety. Because the Manitow Service is not intended for minors, no one under 18 (and certainly no children under 13) is permitted to register with or use the Manitow Service. We do not knowingly collect personal information from anyone under the age of 18. If we are notified that we have gathered personal information from a person under 18, we will delete that information immediately upon notification. 11.4 CUSTOMERS OUTSIDE OF CANADA
